Arbitration

Arbitration in legal matters is a method of resolving disputes in which the parties refer their dispute to one or more arbitrators instead of going to court. Referral to arbitration may be provided as a condition of arbitration at the time of contract preparation or may be referred to the arbitrator after a dispute arises.

Reasons for Using Arbitration:

Unlike courts, arbitrators are not required to follow the rules and formalities of the procedure, which will speed up the proceedings and resolve disputes, and will also cost much less than court proceedings.

The arbitral award is as final and binding as the court verdict. Moreover, arbitral awards are single-stage, unlike judicial authorities where they will go through two or more stages in many cases. Not all disputes can be referred to arbitration. The law set out what types of disputes can be resolved through arbitration and what types of disputes should be dealt with exclusively in court. Arbitration is different from mediation. The mediator only facilitates negotiations between the two parties and gives them proposals to resolve the dispute, but does not have the authority to vote and resolve the dispute.

It is recommended to use arbitration in legal contracts, and if it is not foreseen, to use arbitration to resolve the dispute.

Advocacy

Advocacy basically consists of two parts: civil and judicial. In the civil section, all non-judicial matters such as sale and purchase, rent, loan, mortgage, etc. can be delegated to another person in a civil manner to be performed on behalf of the client by proxy. In judicial cases where a complaint or lawsuit is brought before the judicial and quasi-judicial authorities or defense before them, we cannot give power of attorney to any natural person or legal entity, and that person must be a competent person from official authorities, who is an attorney at law. Therefore, the representation of a non-lawyer is not accepted in judicial and quasi-judicial authorities. Clients should note that in order to choose an attorney, they must use the services of attorneys who have a good background and information in legal, judicial, and advocacy matters, and be sure to refer to an attorney’s office or reputable law firms to receive advice and choose an attorney. It should also be noted that advocacy and legal affairs are specialized and the study and resolution of the simplest legal issues and problems from the viewpoint of individuals may be among the complex and sensitive legal issues that are beyond the control of individuals. It is recommended that all people receive counseling and legal services from a capable attorney, even collectively and as a family, such as insurance before and after any work.

Remember that the time of the hearing and the outcome of the lawsuit is not at the discretion of the attorney, and an honorable attorney never promises the outcome and duration of the hearing to his client.
